Extended Producer Responsibility (click to read more) is a policy approach that has gained traction, aiming to shift responsibility for recycling and related post-use costs of packaging and other recyclable goods away from consumers or governments and onto “producers” – a definition that affects direct mailers and brand-owner retailers. EPR laws have gone into effect in several states, obligations are beginning to ramp up, and penalties can be costly. Given all this, along with the broad scope of “producers” and “covered materials” under many of these laws, it is important to determine if and/or how your business is subject to these requirements BEFORE you run afoul of them.
